These Terms and Conditions are applicable and binding on both users- those who visit the Website (“User(s)”) and those who are registered on the Website ("Member(s)”).
Before completing any purchase on the Website, Users can sign up as Members on the Website. In order to create an account, the User must provide personal information, including but not limited to full name, e-mail, contact number, and complete address, as well as a customer verification question (for instance, your one-time password- OTP), which will be used for verification. Registration is only necessary once, and if a member has already registered, he or she must sign in to access their account. The Member shall after registration for all further communication on the Website, only use the registered email address and/or phone number through which the account was created.
In order to use the Website, you must have a compatible mobile phone or device with internet access (third party charges may apply) which can access the Website and which may require upgrades from time to time. As a Member, you hereby agree and undertake that You will not transfer Your account details and password with anyone. The confidentiality of Your username and password is to be maintained by You as Your sole responsibility and in case of any misuse or unauthorized access of Your account, you shall be solely liable for the same. Further, in case of any such misuse or unauthorized access it would be Your responsibility to immediately inform and notify LadyBug Jewels by contacting us. You are responsible for all the activity that occurs in Your account and agree to maintain the security of Your account.
Where Your account details are used to log into Your account, LadyBug Jewels will assume that it is You that is logging into Your account and that You have agreed to disclose any information where necessary and we will act on any instruction in Your account without taking any further confirmation from You. LadyBug Jewels may at any time ask You to change Your account login details for security reasons or even otherwise.
Products
All jewelry is made-to-order unless stated otherwise. Minor variations in weight, finish, or stone appearance may occur due to the handcrafted nature of jewelry. Product images are illustrative; actual products may differ slightly.
Payments
For the orders which are shipped within the territories of India then the payment is required to be made and accepted only in Indian Currency i.e., INR for which the price would be Maximum Retail Price (“MRP”) inclusive of CGST/SGST/UTGST and IGST, as per current applicable rates/taxes.
- Full payment must be made in advance. Production begins only after payment confirmation.
- Accepted methods: Credit/Debit Cards, UPI, NEFT, RTGS. We also accept payments through the Razorpay gateway
- In case of a purchaser using the credit card then the amount would be required to be made in Indian Currency Only (INR) for which conversion would be made accordingly and conversion charges may apply.
- Cash on Delivery (COD) is not available.
- We reserve the right to cancel suspicious and fraudulent transactions.
Pricing
To provide You with the best value, our pricing is determined using the most recent values for precious metals and gems. Due to fluctuations in the price of precious metals and gems, these prices do occasionally alter, which also affects our prices. Without prior warning, prices may vary on our website. Please be aware that You will be charged the amount mentioned for LadyBug items you purchase on the day of purchase.
Fraudulent Transactions
In the event that someone uses this Website fraudulently, KR Creations reserves the right to pursue financial compensation from them for the cost of the items, collection fees, damages to LadyBug Jewels, and legal fees. Regarding such individuals' fraudulent use of the Website and any other illegal conduct or acts or omissions that violate these Terms and Conditions, KR Creations maintains the right to bring legal action against them.
Jewelry Certification
All gold jewelry of 14 Karat (14K) and 18 Karat (18K) purity sold by the Company is hallmarked in accordance with the standards prescribed by the Bureau of Indian Standards (BIS). The BIS hallmarks serve as evidence of metal purity as per applicable regulatory requirements.
Diamonds used in our jewelry, where specified, may be accompanied by grading or certification reports issued by independent gemological laboratories such SGL. The Company does not independently warrant or guarantee the grading determinations made by such laboratories.
Certificates, where applicable, shall be provided along with the product documentation at the time of delivery.
Variation In Product Weight
The product weight and amounts mentioned on the website for jewellery may vary depending on the final manufacturing. If the customer receives a product with a lower product weight than the value paid for, the company will refund the difference. Similarly, if the product weighs more than the price paid for it, the buyer will be charged an additional fee for the same. The weight difference will be revealed only after the final product is completed. Similarly, the weight of gold, diamonds, precious stones, and gemstones may vary when the finished product is delivered after manufacturing.
Order Modifications & Cancellations
Requests for order modification or cancellation must be made within 24 (twenty-four) hours of order placement, along with the relevant order details. Such requests shall be subject to review and acceptance at the sole discretion of the Company.
Once the order has entered the production process, manufacturing stage, customization stage, or has been dispatched for shipment, the order shall be deemed final and non-cancellable and no refund shall be payable.
Notwithstanding the above, the Company may, at its sole and absolute discretion and without any obligation to do so, offer store credit in lieu of cancellation. The issuance, value, validity, and terms of use of such store credit shall be determined exclusively by the Company and shall be binding on the customer.
Shipping & Delivery
The Company undertakes to dispatch products within the estimated timelines communicated on the Website, which for made-to-order jewelry shall generally be a minimum of 15 (fifteen) business days from confirmation of payment. Estimated delivery timelines, typically 3-4 weeks, are indicative in nature and shall not be construed as a strict or guaranteed timeline.
Delivery timelines may vary depending on product specifications, customization, location of delivery noted by the customer, logistics constraints, and circumstances beyond the reasonable control of the Company. The Company shall not be liable for delays caused by courier partners, transportation disruptions, regulatory restrictions, force majeure events, or any other external factors.
All shipments are insured until delivery. Risk of loss or damage to the product shall pass to the customer upon successful delivery to the shipping address provided at the time of order. The Company shall not be responsible for incorrect or incomplete address details provided by the customer.
The Company does not provide or guarantee delivery at specific time slots. Proof of delivery provided by the logistics partner shall constitute sufficient evidence of delivery.
Custom & Personalized Orders
Products that are customized, personalized, engraved, specially manufactured, or modified as per customer specifications (including but not limited to design alterations, gemstone selection, size changes, or bespoke creations) shall be treated as custom orders.
Upon customer approval of design, specifications, or measurements, the order shall be deemed final and binding. Custom orders cannot be called, returned, exchanged, or refunded under any circumstances, except in cases of manufacturing defect verified by the Company.
The company shall not be liable for dissatisfaction arising from subjective preferences, incorrect size information provided by the customer, or variation inherent to handcrafted jewelry.
Any modification request after approval may not be accommodated and, if accepted, may attract additional charges and revised delivery timelines.
Force Majeure / Inevitable Accident / Unavoidable Casualty
We are not liable for any delay in the performance or non-performance of any of our obligations hereunder and shall not be liable for any loss or damages caused thereby where the same is occasioned by any cause whatsoever that is beyond our reasonable control including but not limited to an act of God, fire, explosion, earthquake, floods, acts of terrorism, failure of internet or computer/telecom equipment, cyber-attack, change in any government regulations, war, civil disturbance, riots, strikes, lock-outs, governmental or parliamentary restrictions, prohibitions or enactments of any kind, pandemic, epidemic, import or export regulations, exchange control regulations or accident or non-availability/ delay in transport.
Final Sale/ No Return Policy
All products sold by LadyBug Jewels (K R Creations) are final sale items. Due to the nature of precious metal and gemstone jewelry, fluctuations in material pricing, hygiene considerations, and made-to-order manufacturing process, no returns, refunds, exchanges, or cancellations shall be permitted once an order has been confirmed and payment has been successfully processed.
The policy applies, without limitation, to: made-to-order jewelry, customized or personalized pieces, size-altered items, engraved jewelry, special gemstone requests, limited edition or made-on-demand products.
The customer expressly acknowledged and agrees that jewelry purchases are not subject to trial, approval, or return basis, and the differences arising from personal preference, minor variations in weight, finish, color tone, gemstone appearance, or craftsmanship shall not constitute a defect or ground for return.
Refunds shall be considered on in the event of: 1. A manufacturing defect verified by the Company, or 2. Receipt of an incorrect product delivered by the Company. In such cases, the Company reserves the sole right to determine whether the products shall be repaired, replaced, or refunded. The Company’s decision in this regard shall be final and binding.
Under no circumstances shall the Company be obligated to offer a cash refund. Any exception made shall be at the sold and absolute discretion of the Company and shall not be treated as a waiver of this policy for future transactions.
By placing an order on the Website, the Customer confirms acceptance of this Final Sale and No Return Policy in full.
Governing Law
These Terms are governed by the laws of India. Courts of Mumbai, Maharashtra shall have exclusive jurisdiction.
Grievance Officer
Customers who are not satisfied with the customer care response may write to the Grievance Officer for unresolved complaints related to any product or services available on this Website. Customers should share the compliant number, while sharing their grievance with the Grievance Officer.
